Privacy Policy

Swift Forge ("Anthony Leonard EI") operates the Dreamy Tales mobile application. We are committed to protecting your privacy and being transparent about the data we collect.

1. Information We Collect

We collect the following information to provide and improve our services: Account information (Apple ID) for payment processing and to restore your purchases; personalization data you optionally provide (e.g., child's name, age, favorite themes) when creating stories; purchase history and credit usage via RevenueCat; technical data such as device information and crash reports for app stability.

2. Legal Basis for Processing (GDPR)

We process your personal data on the following legal bases: (a) Performance of a contract: processing necessary to provide the service (e.g., Apple ID for purchases, purchase history for restoration). (b) Consent: when you voluntarily provide personalization data (child's name, age, themes) for story creation. (c) Legitimate interest: technical data and crash reports to ensure app stability and improve our services. You may withdraw consent at any time for data processed on that basis.

3. Third-Party Services

We use trusted third-party services: RevenueCat for subscription and purchase management; Apple Inc. for payment processing; OpenAI for AI-generated story content; Google Text-to-Speech for audio narration; Leonardo.ai for story illustrations; Supabase for data storage. Each provider processes data according to their own privacy policies.

4. Transfers Outside the European Union

Some of our service providers (OpenAI, Leonardo.ai, Google, RevenueCat, Apple) are located in the United States or other countries outside the European Economic Area. When we transfer your data to these providers, we implement appropriate safeguards to ensure an adequate level of protection, including: Standard Contractual Clauses (SCCs) approved by the European Commission, and where applicable, supplementary measures. Your story prompts and personalization data may be sent to OpenAI and Leonardo.ai for AI content generation. You may contact us for more details on the safeguards in place.

5. Data Retention

We retain your data only for as long as necessary: Purchase and account data: for the duration of your account plus 3 years after the last activity for legal and accounting purposes. Personalization data (story prompts): deleted after story generation or within 30 days. Technical data and crash reports: up to 24 months. You may request deletion of your data at any time.

6. Data Security & Your Rights

We implement security measures to protect your data. Under GDPR, you have the right to: access, rectify, or delete your personal data; restrict or object to processing; data portability; lodge a complaint with the CNIL (France) or your local supervisory authority. These rights can be exercised at any time.

Terms of Use

By using the Dreamy Tales application, you agree to these terms and the Apple Standard EULA.

License & Restrictions

We grant you a personal, non-exclusive license to use our software. You may not:

  • Decompile or reverse engineer our application.
  • Use our content (stories, illustrations, audio) for commercial purposes.

Subscriptions & Billing

Purchases and credit packs are processed exclusively by Apple Inc. via the App Store. Terms of renewal and cancellation are governed by Apple's App Store policies. You can restore purchases using your Apple ID.

Credit System

Dreamy Tales uses a credit system to unlock premium stories. Credits are consumed when creating or accessing certain content. Credit packs and subscriptions are non-refundable except as required by Apple's policies.

AI-Generated Content

Stories and illustrations in Dreamy Tales are generated by artificial intelligence. While we strive for quality and age-appropriateness, AI-generated content may occasionally contain unexpected elements. Parents and guardians are encouraged to review content with their children. We do not guarantee that all content will be suitable for every child.

Limitation of Liability

Swift Forge provides the application "as is". We are not liable for any indirect damages resulting from the use of our services, including but not limited to AI-generated content.

General Terms of Sale (CGV)

1. Purpose and Scope

These General Terms of Sale (hereinafter "CGV") define the conditions applicable to the purchase of credits, subscriptions, and premium content offered by the Dreamy Tales mobile application (hereinafter "the Application").

By making a purchase, the user acknowledges having read and accepted these terms. Purchase via the Apple App Store implies unreserved acceptance.

3. Services and Pricing

Dreamy Tales offers free stories and premium content accessible via a credit system. Credits can be purchased as one-time packs or through subscriptions. Premium features include AI-generated stories, audio narration, and offline access.

Pricing

Prices for credit packs and subscriptions are displayed in the App Store in the user's local currency. Prices are "Net of Tax" (TVA non applicable). The publisher reserves the right to modify pricing, with at least one month's notice for subscriptions.

4. Delivery

Digital content (credits, subscriptions, stories) is delivered immediately upon confirmation of payment. Access is granted within seconds of purchase. In case of technical delay, the user may contact support.

5. Payment and Renewal

Payment is processed exclusively by Apple Inc. via the App Store. The publisher never has access to your banking details.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Management and cancellation are done via the user's Apple ID Account Settings. Purchases can be restored on other devices using the same Apple ID.

5bis. Modification of the CGV

The publisher reserves the right to modify these CGV at any time. For existing users, any substantial modification will be communicated with at least 30 days' notice (by email or in-app notification). Users who do not accept the new terms may terminate their subscription before the effective date. Continued use of the service after the effective date constitutes acceptance of the modified CGV.

6. Withdrawal and Refunds

In accordance with European regulations on digital content, the user requests immediate access to the service upon purchase. Therefore, the user waives their right of withdrawal once the content delivery has begun.

All refund requests must be handled through Apple Support. The publisher cannot issue refunds directly. Credit packs and consumed credits are non-refundable.

7. Liability and Availability

The publisher strives for availability but is not liable for App Store outages, internet failures, or maintenance. Content is provided for entertainment purposes without a guarantee of specific results.

8. Intellectual Property

The Application and its content (stories, illustrations, audio, design, code) remain the exclusive property of Anthony Leonard EI. Any unauthorized reproduction is prohibited.

9. Dispute Resolution

These CGV are governed by French Law.

Consumer Mediation

In case of a dispute, the user may contact the following mediator: CM2C (https://www.cm2c.net/)

Any dispute shall be brought before the French courts, though consumers may also use the courts of their country of residence.
